Minimum Advertised Price (MAP) Policy
To protect the premium brand image, innovation, and perceived value of Case-Mate products, Case Mate has established this Minimum Advertised Price (“MAP”) Policy. This policy applies to all authorized resellers of Case-Mate products. Retailers must be authorized by Case-Mate to sell its products in any location, including brick and mortar and/or on the internet. Retailers are expected to agree and adhere to the following conditions of the MAP Policy in order to avoid potential consequences of non compliance.
Except as otherwise expressly designated by Case-Mate in writing, all current and carryforward Case Mate products may not be advertised at prices lower than the MAP established by Case-Mate and set forth in its current Case-Mate price list. MAP pricing is calculated by applying a two-times (2x) multiplier to the applicable wholesale cost (e.g., a product with a wholesale cost of $50 would have a MAP of $100). This MAP Policy does not apply to products designated by Case-Mate as end-of-life, discontinued or closeout items.
Scope of Policy
This MAP Policy applies to all forms of advertising, including but not limited to:
• Print (catalogs, mailers, signage, trade shows)
• Digital (websites, email marketing, banner ads)
• Online marketplaces and search engine marketing
• Social media and influencer promotions
For online advertising, MAP applies to any displayed price prior to adding the product to a cart. Prices revealed only after adding a product to a cart or during checkout are not considered “advertised prices” under this policy.
Advertising any Case-Mate product at a price below the established MAP is strictly prohibited absent the prior express written authorization of Case-Mate.
Key Requirements
By purchasing and reselling Case-Mate products, you agree to the following:
• MAP Compliance: Products may not be advertised below the established MAP price (no more than $0.25 below MAP unless otherwise authorized in writing by Case-Mate).
• Authorized Sales Channels: Products may only be sold through approved retail locations and websites that have been authorized in writing by Case-Mate.
• No Unauthorized Marketplaces: Resellers may not sell Case-Mate products on third-party marketplaces (including but not limited to Amazon, eBay, Walmart Marketplace, or similar platforms) without prior written approval.
• No Redistribution: Products may only be sold to end consumers and not for resale to other retailers, distributors, or third parties.
• Brand Integrity: Case-Mate products must be marketed under the reseller’s approved business name. The use of alternate or fictitious business names (DBAs) requires prior written approval.
• Fulfillment Restrictions: Resellers may not dropship or fulfill Case-Mate products on behalf of unauthorized third parties.
Monitoring & Enforcement
Case-Mate actively monitors advertised pricing and reseller activity to ensure compliance with this policy.
Failure to comply with the MAP Policy may result in the following actions:
1. First Violation – Written warning and request for immediate correction
2. Second Violation – Temporary suspension of purchasing privileges
3. Third Violation – Termination of reseller relationship and supply
Case-Mate reserves the right to enforce this policy at its sole discretion. This MAP Policy is unilateral and does not constitute an agreement; Case-Mate will not discuss or negotiate MAP pricing with resellers.
